hi, just wondering if i can get a civil action law suit against my next door nieghbour for en-dangering my life?

i will give you the short story :- she set fire to her kids bedroom while her husband was asleep in the next room and her kids and my sister and me was below her kids bedroom outside, she set fire to the curtains and was calling me to help her so i went in and put the curtains out, she was arrested and convicted in court (pleaded guilty) for arson with intent to endanger life, but she is a bit slow in her head if you know what i mean, she was only given comunity service,, ever since then (last year, i was 15) she has had a vendetta against us, and she set fire to her washing line last weekend and said it was us and went to her solicitor and they sent us a letter saying that if we continue with "this behaviour" she will take us t court! lol,

well anyway my mum said that she can take a civil action against her because she endangerd my life, and i was wondering if i can sue her, she owns a house also, how much could i get?

  1. Sounding from the outcome of the first results, I think you'd have a hard time proving malice on behalf of your neighbor's actions. Sorry.

  2. you have had your reward you were, comended by the judge etc

  3. Reply to the solicitors letter citing the previous case. Stating that if the harrassment continues you will take action. OR Inform the police of her actions and see if they can take any action.

Does she own the house that she lives in? If not and it is rented, inform the owner of her actions, which will probably see her evicted.

  4. she needs to go to the funny farm. She is not all there upstairs if you know what i mean. She is obviously a danger to herself and to others which is a clear and cut case for a 51-50. She needs to be locked up in a mental hospital before she murders someone. Suing her for money is not the answer.

  5. let's see... , this is a women who for all intents and purposes attempted to kill her husband; who gave little or no thought to her children or neighbors, and all you're concerned with is how much money you can make off this?

you can make nothing, you are a minor. any legal action you might take would have to be initiated by your parents (as legal guardians), and they have no case. this whole idea is ludicrous, you stood in the yard and watched a house burn and now you want a reward? not happening. case would be dismissed two minutes into it. then you (you parents) are charged with frivolous lawsuit, and you owe her and the court money.

  6. Listen!!

Kepp a diary of everything she does.

Report her to the police each time she is harassing you, the police in the UK take this very seriously these days, by caling them you will not be charged with wasting police time.

Do all you can to protect yourself. Ask another neighbour if he/she will support you or if they have had problems with her also.

You will need as much information as possible to support your claim against her.

SO KEEP THAT DIARY AND CALL POLICE, GET WITNESSES

  7. There's one thing here you must have, but you havn't, and that is PROOF, so be careful it doesn't backfire on you.

  8. She has done the smart thing by sending you a solicitor's letter first so she can't be that crazy.

If you are sensible your Mum will put cameras in the windows of your front and back garden to gather any proof of her trying to blame you for something she has done herself,

She didn't endanger your life although she probably endangered her childrens life if they were at home when the fire started, unfortunately you responded to her request for help.

It must be a nightmare living next to someone like that.

  9. you were outside, there was no real danger to your life, you would have been alerted to the fire before you could have came to any harm.

You have no chance of legal action

  10. A law suit for endangering your life? According to your statement you are wondering if you can sue her, and that neighbor of yours owns a house, and how much could you possibly get. IT SEEM to me the only intention you have in suing her was for money not for INJUSTICE. Which is NOT, I repeat...not allowed by law. You have an ulterior motive behind the law suit.

It is obviously you DO NOT KNOW THE PRINCIPLE of the law itself. Those who come forth and accuse someone MUST COME WITH A CLEAN HAND, meaning when you file a complain to the court you have no other intention but to brought justice to your cause. BUT IN YOUR CASE, you ain't got no cause but to gain money instead.

According to your story, there is no DIRECT LINK to your life when she set those fire. But if those fire she your own house on fire then there is the motive and the endangerment to your own life but to your story there is none what to speak of even if you discussed this to a lawyer you got no case. UNLESS the lawyer you will get has the same idea like you to gain MORE MONEY out of nothing, and cooking up story.

  11. a lawyer could help or the council with an asbo, put you somewhere else but your parents have to do it as you are only a minor
