HOA refuses to return calls and respond to my repair?

My association dues cover slab leak, which is a fortunate thing because that exactly what I had in Sept. 07. My HOA sent out a plumber to take care of the leak and restoration. About a week later they send a company called V&M Restoration to do the complete restoration including drywall, painting and replacement of the pergo flooring. Every thing was done well except the flooring. In about a week, my pergo flooring started buckling. It's like a dominoe effect, it keeps getting worst. It got so bad that I called the association to explain to them my situation. V&M Restoration sent out their guy to look at it and responded back. I called the HOA again and was told that V&M Restoration went out of business and that there's nothing they could do about.it. I explained how urgent this matter is because I have to young kids running in the house and constantly tripping on the floor. I've waited months, no response. Now it's 7/09/08, nothing done. They said the board won't approve it.

  1. Read your homeowners assn. rules then get a lawyer.It appears that they were accepting responsibility and now don't want to.


  2. This is a sticky situation.  The HOA was responsible for the repairs.   You had problems with one of the repairs but unfortunately the company went out of business.  It may come down to the exact timing between when the repair was completed and when you first tried to complain about it.

    If you haven't done so already, send a written complaint to the HOA as well as to each individual board member.  Provide copies of bills and any correspondence you have had with the HOA.  Hopefully you have documented everything.  If they still continue to ignore you, try to attend the next HOA meeting and bring up your complaint in front of everyone.  Don't be hostile - stay calm and tell the whole story from start to finish.

    Based on your story, I would think that the HOA is responsible for the repair.  However, HOA are notorious for being cheap.  In some cases, HOA's would rather go to court than pay what they owe.
