HOV Lane in NY Requires 2 passengers, right?

A friend of mine said she saw a cop use a hand-held radar to scan her license plate on her car as she drove past him (his car was stopped on the side of the L.I.E. in NY. She was heading toward Long Island on the HOV lane with a friend (so there were 2 passengers). They were both wearing their seat belts. Was it just a routine license check?
