HOW DO I GET OUT MY KIDS OUT OF COURT ORDERED VISITATION WITH AUNT AND UNCLE?

THE AUNT CALLED SOCIAL SERVICES AND REPORTED FALSE ACCUSATIONS OF ABUSE AND NEGELET OF MY KIDS. THE TOOK OUR KIDS AWAY AND PLACED THEM WITH HER AND HER HUSBAND WHICH KEEP IN MIND IS A FELON. IT WENT TO COURT AND WE WERE GRANTED OUR KIDS BACK WITH NO CHARGES FILED BECAUSE OF NO EVIDENCE. BUT THE JUDGE GRANTED THE AUNT AND UNCLE VISITATION EVERY OTHER WEEKEND FROM 8:OO AM ON SAT TO 6:00 PM ON SUNDAY. MY KIDS DO NOT WANT TO GO OVER THERE BECAUSE OF ALL THE LIES AND STUFF THEY SAID ABOUT ME AND THEIR DAD. WHAT DO I DO? WE SENT THEM THE FIRST WEEKEND AND THE AUNT AND UNCLE BADGERED THE KIDS WITH QUESTION ON IF WE HURT THEM AND WHAT WE HAVE SAID TO THEM AND BULL LIKE THAT. THAT IS NOT RIGHT FOR THEM TO HAVE TO GO AND LISTEN TO THAT. NOW MY KIDS ARE EVEN TRYING TO MAKE THEMSELVES SICK SO THEY WON'T HAVE TO GO. WHAT DO I DO?

  1. The court order says they have visitation rights during that period but there is no law that says a kids will always do what is expected of them and they simply refuse to go because of reasons you gave. The police usually wont get involved in these family matters as its more civil than criminal. But you can expect trouble from Uncle and Aunt the first time they refuse, but then you explain to the courts what you told us and have the kids tell the Judge why they refuse to go. No guarantees but is worth a try

When a court issues an order with which you disagree, you appeal.  The order is valid until it is reversed by the appeals court.  There are strict time limits for an appeal and if you let that time go by, there is nothing you can do about it.   You can also file a motion asking the judge to reconsider, or alter the visitation.  If you simply decide for yourself to not obey the order, without getting it changed, you will be held in contempt of court and may get a jail sentence.

  4. Did you have a Lawyer when you went to court? If so you need to contact the lawyer to find out exactly what you have to do. But you should be able to go back before the judge and let him or her know all the details of what is going on with the children and the aunt and uncle. The judge is the only one who can reverse the court order. But do make sure you bring it up about the felony. Someone needs to do a background check on the aunt and uncle to find what kind of people they are.

    You need to write a letter to the judge so that he may overturn the verdict.

  6. You need a lawyer.  I would say that the judge violated your parental rights to determine who your children visit.
