Had an accident, the other party is ignoring my calls !?

I had an accident and the rear bumper is damaged ! the other party admitted that she's at fault and said that her Insurance company will handle this. Since there is no Injuries we didn't call the cops.

I wrote down most of her information (name, phone, Title, License Plate, address ...etc) but somehow I failed to record her Insurance company name !! I called my insurance company and they said the I have to call her and know the name of her company. Now when I try to call her, she's not picking up any of my calls ! what can I do now?

  1. ksmink 19 is the only person with the right answer, mostly.

    Your insurance company is wrong.   If you have collission coverage then let your insurance company handle fixing your car. and they will be going after that driver.

    If you don't have collision insurance then you need to take that person to small claims.  


  2. maybe they are checking at the doctor to make sure there are no internal injuries


  3. Go ahead and get some estimates, you will want them when she responds anyway, to know if you are getting ripped off or not.....

    March down to the magistrates office, and file a claim in small claims court.  They can guide you through the process.

    Bottom line, she hit you, her fault, she has to pay, and it is her call if she is going to involve her insurance company or not,,,, at this point.

    Alternative is to file the police report, and see if they can get her insurance information.  If you have that, she is out of the loop.  

    If the damage is less than 2K, she is stupid to file it on her insurance, she should just write a check.

    I prefer the magistrate, since they WILL BE COMPELLED to appear.  Nothing like a summons delivered at work to get someone's attention.  

  4. Call the police, file a report, you can still report it even after the fact. They will get her information for you and she will soon realize what a stupid decision she made ignoring your calls.

  6. You should have still filed a police report. You do this at the police station. You said you have her address, go there.

  7. Well you should have called the cops first off even if there were no injuries.  

    This person could be uninsured, you don't know he (or she) isn't

    What you can do now is try to track down her insurance company through the DMV using her name, phone#, license plate #..if they will allow you access to this information.  

  8. If your city is like my city (sounds like it is), the police don't respond to accidents with no injuries where both cars can be driven away.

    But (I found this out last year) you *can* call the police later, they'll send an officer out to take your statement and you'll have a police report.

    If it turns out you can do this, then I say do it, and leave another message for the other party, telling her what you've just done.
