Harrasment Laws in Illinois.. Help PLease?

Ok, My ex was told by police and by me to stay away from me and

to not have ANY contact with me. After I told him to NEVER contact me again. He sent me a message. I haven't opened so I do not know what it says. Nor Do I plan to open it until I can get a hold of the cops on this. But I need to know if I can sue him for harassment?

And he also told me court things (that I already knew but...) that are to be confidential between him and the other person and he told me, is there anything I can do about that?

  1. In the US anyone can sue anyone for anything. So yes you can sue. As to criminal stuff.  In Illinois just because the cops said no contact that does not mean no contact. The police do not have any enforcement powers over their own no contact order.

    If a judge ordered no contact but did not issue a "order of protection" then you must go back to that same judge with your complaint.

    If an order of protection was issued and he is in violation of the specifics written in that order then you make a police report each time he makes the violation, so he can be arrested for the violation.

    If there is a no contact order of protection and you initiate the contact you can have a lot of problems because the judges order goes both ways.

    Violating a judicial confidence has to be taken up with the court.  


  2. Your second part of the question is hard to understand.

    Suing him is civil and is not a question for police.  We deal in criminal law.  You can have him arrested - if the text message is harrassing. There is a law in Illinois for electronic messaging and harrassment - same as telephone.  I would explore your options for an order of protection.  If there was prior abuse in the relationship, you should take that route.
