a bunch of my friends and i were in the lunchroom, when i wanted some water from the water cooler but no cups. so, i looked on top of the fridge because sometimes people store cups up there. in a container there was a cell phone with no name. the others and i wanted to know who this phone belong to. we all thought it was lost. so we went into some of phone messages to find out. we figured out who the phone belong to by the voice message. now this person is charging us with harassment. did he loose his privacy by leaving his phone in a public place?

  1. Are you being criminally charged with harassment? If so you can sue the DA for malicious prosecution.

There is no harassment claim here.

You probably should have just brought the phone to lost and found. You did invade his privacy, but he should deal.

  2. If you have home insurance, usually they will cover your butt. In your case, there are no laws which will allow him to sue you. By his phone being in a public place, anybody could take it. He's lucky noone stole it.

  3. People sue... or threaten to sue... even when they doubt they will win they want to scare you into settling outside of court. that way it is all free money for them :D

  4. It's "lose", not "loose".
