14th Amendment: Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

McCain made 32 propaganda films for North Vietnam.

  1. Your hate for the man is showing and your ignorance is far greater than many believe!

    You do not know why this amendment was put into play and when Senator McCain was held hostage he was tortured beyond belief. I doubt that you or I would have done anything other than what he did.


  2. He doesn't need an exception.  His "propaganda films" as you call them were made under torture, duress, and threat of death.  I'll bet you wouldn't even ask this question if Jane Fonda were running for office.

  3. No, McCain hasn't received approval. His actions as a traitor have made him a figurehead in the Republican party, but ineligible for the Presidency.

  4. I seriously doubt that the issue will be raised or addressed. This provision was obviously intended to address 'unreconstructed' politicians, officers and soldiers of the Confederacy. I know of no instance not connected with the Civil War in which this provision was invoked.

    If there have been 'post-bellum' invocations of this provision, I will stand corrected.

    In addition (and perhaps more to the point), Captain McCain was coerced into making those films and did not give aid and comfort to the North Vietnamese willingly and intentionally. Nobody can honestly make a legitimate argument that he is or was a traitor - which, again, is what this provision of the 14th Amendment was aimed at.

    Time to come back to reality.

  5. Let's see.  McCain was held for five years, tortured and refused release (once the VN found out his dad was an admiral).  They forced him to make the films.  No prisoner can be held accountable for any act forced upon him by the enemy in violation of international law.

  7. No, and he doesn't need it. This is a poor question that is based on a false premise. The fact that some conservatives are engaging in groundless attacks on the character of Obama, does not give you a license to do the same against McCain.
