Has anyone been successful in applying for a tourist visa after overstaying in the US.?Pls share experience?

  1. I'm not sure about the tourist visa, but I can tell you that I was in fact successful staying here for 3 months after my TN employer laid me off. Technically speaking you are supposed to be out of country within 10 days of the termination of employment with TN/H-1B. So I was supposed to get a tourist visa to cover the gap, but I didn't because my TN was still good for 6 more months...even though I did not work for that employer anymore. It is kind of rediculous for the government to expect you to leave within 10 days, especially if you work down in the South like I do...how am I going to sell my house and move all of my sh*t up to Canada in 10 days? It would take me almost the whole 10 days just to make a single road trip up there :)

    I have since found a new job and got a new TN and H-1B approved, despite being here for 3-months in a questionable status and having not left the country the whole time. Goes to show you how much the government really keeps tabs on those things.
