Has anyone ever been sued by Wolpoff & Abramson?

I received a letter from the court saying that I was being sued by them for $1800.00. Not even near the amount that I owe. If anyone has good advice about them or being sued...Please advise.

  1. First, check with the court to make sure a lawsuit has really been filed.  Collection agencies often send out summons or documents that look official when in reality, no lawsuit has been filed.  It's a scare tactic.

    If it's really a lawsuit, try to negotiate a settlement before going to court.  A judgment would further damage your credit file.  If you can't settle, still show up.  You might be able to get some of the interest and fees removed.

    How old is this debt?  Check the Statute of Limitations (SOL), the timeframe to bring lawsuit, for your state:  http://www.bcsalliance.com/statute_of_li...  The time typically starts from the last activity or last payment.  If the debt is beyond the SOL, this is an affirmative defense in court.

  3. Nope and sorry to hear you are going to be. Doesn't really matter who they are...just another company after a debt..they're pretty much all the same.

    Well obviously you didn't pay a creditor, the account went to collections...you still didn't pay and now the last option is to sue you. You received a summons to appear in court and satisfy a debt of $1800.....it's probably a lot higher because it's been attracting large interest rates and fees from the time your account went in default.

    I say pay what you owe. Show up to your hearing and try to plead to a lesser amount. Don't ever miss paying your bills again.  Good luck
