  1. People argue against HMRC all the time and i'd imagine win at least as much as they lose. For instance everytime you have heard of a tax court case in the news (ie: M&S tea cakes etc), that's because is fighting the Revenue and won at least in the lower courts.

    If you are right and they are wrong there is no reason you won't win as long as you know what your are talking about.

    However a lot of people tend to think they are right when they are wrong (ie: tax credit overpayments being repaid) and they do tend to lose.....


  2. Yes I have frequently as that is what I am paid to do.

    I regularly challenge HMRC over Tax Credits and although time consuming, annoying and without HMRC co-operation the cases are relatively easy to win.

    Through my job I have an excellent knowledge if Welfare law, which is required to tackle HMRC. Mostly they will relent after a battle, occasionally there is no way forward so it has to go to an independent appeal, where cases are invariably won

  4. Yes.  They charged interest when they shouldn't have done.  (Probably someone pressed the wrong button).  

    I claimed it back - they refused.  

    I appealed to the Inspector - he ignored me.  

    I complained under their Code of Practice - complaint rejected.  

    I appealed to the Area Director - appeal upheld, I got the interest back plus £300 compensation.

    You need to be sure of your facts before you start.
