Has anyone ever heard of Early Financial or Early Payday Advance? I took a loan with them, im sorry I did.?

Apparently, since I moved my checking account they haven't been able to get payments, so instead of contacting me, they got a processor and she called me today and stated that she has filed with the courts and sheriffs department and I will be arrested and booked for checking fraud. What I do not' get is why didn't anyone call me. I totally forgot about these people. The last payment they took was 8/19/06 and well, it's been month. Has anyone had a problems like this. Am I going to jail. I am so scared.

  1. I would get a lawyer and ask. If it's a small amount they'd lose money taking you to court-- even if they win-- so it's not likely. Once it's to a creditor, they aren't going to do anything no matter how long you wait to pay.

    Creditors are trained to say anything to get you to pay-- they can be rude as they want. They get paid to make you pay.


  2. Due to the timeline, you will not go to jail, but you most likely will get a fine.  Claiming you forgot will not stand up in court.  Call them up and work out a payment plan and see if they will knock off some of the interest.

  3. I don't really think that you forgot about these people, but what's done is done. Send them the amount owed. If they cash the check, they have accepted payment in full. I doubt this was a processor but a collection company paid by the company to collect a debt. She cannot tell you that you are going to jail. That is what judges are for, this is a scare tactic that worked. Pay your debt and be done with it.

    Don't ever borrow money from the Payday Advance companies. Bad news. It's legal but borders on being a loan shark.

It would have been more courteous if they had called you, but in all actuality, they don't have to do so, as it is YOUR responsibility to pay.  When you moved your checking account, they immediatly assumed it was an attempt to avoid payments, since you didn't notify them of the new information.  Essentially, when you take a payday loan, you write them a check.  The terms of the loan specifically state the consequences of non-payment, which means them attempting to cash the check in order to regain funds.  If the account was closed, it came back as fraudulent.  You need to call and talk to the loan company and see about paying them in full, in addition to any amount it cost them to file against you, or it certainly sound as tho you will be getting picked up on that warrant.  Whether you intentionally defrauded them or not is moot-- the fact is, you did.

  5. Usually they will give you a chance to pay the bad check through the District Attorney's office. You need to contact the DA's office and ask if you can pay it now. I don't think they'll accept multiple payments on one check so be sure you have ALL the money up front.

    Otherwise, they will definitely take you to jail if you are unable to pay the check.

  6. 2006?  Well, it's partly their fault for not alerting you.  

    But, legally you are still at fault for not paying.  You really should have noticed the lack of that check clearing with these vultures.

    Still, this is what to do.  Call them up and ask to speak to a manager.  Explain the situation to someone with a brain.  They may, or may not, have actually starting legal proceedings against you.  Bill collectors will say anything to scare you into paying.  I hope you have the funds to pay them back?  I'll assume you do.  Offer them whatever the balance that is due and they will probably bite. They can take you to court and maybe have you fine or thrown into jail.  But, they means you don't earn money to pay them back with.  Tell this that.  Be courteous and if they start yelling calmly tell them you  will call them back in two days, you will not be yelled at, but will deal with them on an adult level.  They want their money more than they want you.  This is a problem that you can throw money at.  Just make sure you get any agreements in writing because these type will lie to your face.  

    Do NOT give them electronic access to you bank account.  They will clean you out.  You might protest but no judge will give you back money from a company you owe money to.  Checks, money orders and cashier's checks work here.  

    You may be getting a second job and cutting back on all but the essentials until these people are paid and out of you life.

  7. Anytime you take a loan out the lender(Early Payday Advance) expects the Barrower (you) to pay on the loan monthly. Why they did not contact you before this is a mystery to me.

    I think I would contact an attorney that gives free advice on different legal matters and ask what you can do to stop these proceedings. See what legal rights you have (if any)since you were not contacted.

    I don't know if you moved and changed checking. Most of the time they contact your employer and take it from your wages.

    Either way it gives you a  bad credit score and hurts you in further loans. Good luck because most of the places that give payday advances is bad news. You get buried until they have your whole paycheck and its a vicious cycle.

In effect, by moving your bank account and not notifying them you have committed fraud.  However, if the amount was not that great and you have several credit accounts the court may accept that it was an oversight on your part and not intentional.  You still owe the money, interest, fines and litigation fees.

    They may not have pressed charges as yet and are threatening to do so to get you to pay up.  Arrange a realistic payment schedule.

    If you are the defendant in a criminal case you are entitled to free legal services from a court-appointed attorney.
