Has anyone ever heard of a parent taking legal action....?

against a school or day care because of an incident involving a child with special needs? If so, please share.

  1. There are so many!   Check with your local courts about lawsuits filed against a particular plaintiff - read the court files - and see if there has been a similar issue to yours.  Yes, its going to take a day or two at the court house.


  2. There are several parents that do. Consult a lawyer if you feel that there is a problem.

  3. i used to work in public schoolsa s a teacher of teh handicapped-and I would've testifeid for teh parents if they sued-

    I was assigned to a class I was unqualified to teach (as were others)

    There were significant healt violations

    a special needs school ingored IEPs and said all studnets were to use 1 reading program-even though some students had LD and some had autism....

  4. Oh lord yes. go to wrightslaw.com, they have court cases listed with info on each one.

    Some of these cases go all the way up to supreme court becasue schools keep apealling because the courts rule in favor of the parents.

    It is horrendous all across the US

  5. In special education, there are appeals processes set up when the parents--and student themselves--believe the school is violating the rights of the student to recieve Free Apropriate Public Education not complying with the Individualized Education Process.

  6. Yes I work for the district in special ed as an aide (assists the teacher) and it happens all the time. If there is a service the child should be recieving but is not this is legimate for action to be taken. there is a process though I'm not sure what its like, but I've had teachers tell me not to even talk to the parents of the students I work with because if I saw something wrong then the district could be sued.
