Has anyone fhave experience with bankrupcy chapeter 13, and can i doit?

  1. Strongly advise against filing any type of bankruptcy will the new laws. In the bankruptcy filing...do you know if you qualify for a chapter 7 and not the chapter 13??? Do you know how to submit motions to the courts, can you write up a plan payment and submit that to the courts so that they deduct the payments and send to the trustees office? If you answered no to these questions.....Find an attorney in your area, most see you on a first free consultation, they will need your last 6 months of pay stubs, a list of all your debt, assets, and last 4 years of taxes. Once reviewed they can tell you what you qualify for.

  2. This is not a do-it-yourself situation.  Look in the phone book for bankruptcy attorneys and choose at least two.  Your consultation will be free, and you can find out who you would like to have handle it for you.

  3. I never recommend you do your own bankruptcy work.  If you make one single error, file the wrong form, or do any of a million things wrong..your BK will be dismissed and you will have to start all over again.....in 6 months!

    During that period you can bet your creditors will be working real hard to collect whatever they can.

    I have seen a lot of BK attorneys mess up their clients cases over silly errors....do you think you can do any better?

    Before you go into BK 13, You need to really sit down and figure out if you really NEED to go to the extent of a chap 13
