  1. I have never gotten his taxes for back child support, even though he is more than $10k behind.  The child support agency swears they have placed an offset against his tax return, so maybe he doesn't file.  I am not sure.  I have been told (by the child support agency) that it may take up to 6 months to receive anything if it is taken.  The 6 months is to allow the obligor the opportunity to appeal the garnishment.

  2. It can take six months or more.   If the ex is remarried, the IRS has to sit on it for six months to allow the new spouse to file an injured spouse form.  Once the six months is past, then IRS sends the money to the state who then sends in on to you.  That could take another six weeks.  Hopefully, it does not take that long, but don't hold your breath waiting for it!
