Has anyone out there been sued by Cash Call?

In May of 2006 I took out a loan with Cash Call. After a year of making my payments on time, my ex disappeared and stop paying his child support. I could no longer make my monthly payment. I called Cash Call to make arrangements and they told me I could make one more payment and they would defer it for two months. When I called them a week later to ask for the deferrment agreement they said it had been denied and that I owe for the next month. I couldn't pay and started to get harrassing phone calls, even after I tried to work with them. The original sum I had taken has already been paid back. I just wanted lower payments. They threatened my job, called my family and coworkers, pretended they were the sherriff when they called, told me not to feed my kids and pay my loan, and called me trailer park trash. I couldn't take it and stopped answering the phone. Yesterday at work they served me and I have to be in Small Claims court on 8/20. Any advice would be much appreciated!

  1. First, you need to file an answer to the court.  You can say anything, but do it RIGHT AWAY!!  If you don't, it's automatic guilt and they will put a judgment on you.  Once you file the answer, then you can go to court and tell the judge your side of the story.  They should be able to set up arrangements with you.  Don't worry too much.  You owe the money...so you do need to pay, but it won't be as bad as you think if you file to correct steps now.
