Question:

Has anyone received a processed amended return and their stimulus check?

I filled our amended return April 15, 2008. I have called the irs every two weeks to check the status. On July 15th I was told that it has been over the 12 weeks and that he would write a referral. From this point there are three options the irs can take; 1. process my amended return and dispurse the refund and my stimulus check; 2. send a letter requesting more time; 3. nothing - in which case I have to call the irs back in 30 days and a tax advocate will intervene on my behalf. I would like to know if anyone else has incurred this problem and if so how long did it take to get resolved or are you still waiting too?

  1. Try to be as patient as you can, the stimulus payment has doubeled the amount of work the IRS has to do.

The service center usually responds to the tax payer in the time frame of the referral.  If they don't, then you can have a referral to the taxpayers advocate office.

You mentioned 3 things that could happen, there is a 4th, they could ask for more information to process the return.

  2. I am also facing the same thing and it is ridiculous because they are also delaying my stimulus check until they are done with the amended tax return. I did not know about the letter requesting more time or the tax advocate though I was not informed.

  3. First of all IRS is trying to process original tax returns.  Why should taxpayers filing original have to be delayed because you didn't file your return correctly from the beginning.

second of all If TAS gets involved they have 30-45 days to resolve the issue.  In which of course you are delaying the process even more.  The TAS can't speed up the processing of the return.  All they do is call the department processing the return and ask the status and ask if it can be processed quicker but it is out of your hands to get the return processed immediately.

Sit tight and wait and you did it to yourself.  Calling every two weeks is not going to help any.

  4. I have the same problem. I filed an amendment to my original taxes on April 14th. I still have not received my stimulus check. I called the IRS in June and they said to wait 30 days. Called the IRS again on July 16th. Got the same answers of we will put a referral out about your amendment and as soon as that is closed your stimulus check will be processed. However, it will take up to 30 days for someone from the IRS to contact you. Pretty much thats all you can do is wait. Aggravating? ... YES! But, There is really nothing else you can do. Pissing off the IRS is not going to get you your check any quicker.  Oh and "P.S." to the answer that ASSUMED that ammendments were filed to delay an efiling date......it is my EMPLOYERS fault that I (along with about 100 out of 600 employees at the company I work for) had to file an ammendment not mine. We didnt do this to ourselves!

  5. Since people get impatient and call the IRS to check the status of their amended returns and then panic if they assistor doesn't see the amended return, the IRS generally posts a flag indicating that an amended return has been received.

The flag does not indicate whether the 1040X is for a refund or if money is due--because normally this is not an issue.  Since many people do owe, the IRS will not release any other money until the 1040X is processed.  (Because if you owe, that money is going to be applied to the debt.)

Unfortunately, for 2008, the workload at the IRS service center has doubled due to both the rebate and an unusually high number of amended returns.  The referral and the advocate cannot really speed things up if this is simply due to the backlog.

PS, why were you filing an amended return?  Why wasn't your original return correct?  Filing an amended return was never intended to get around efiling delays (as in the delay on the education credit) or to get around rejection codes (as in divorced parents both claiming the same child).  If you could have avoided the 1040X by either waiting to file or by sending in a PAPER return, you should have.
