Have I Been Over Punished???

I was stopped by the police on the way back from scotland at new year 08, when the policeman approach me he said we believe your car is uninsured, i was shocked as i was under the impression i was, fully comp too. I was told to produce my details at the local station. on returning home very tierd i made a call to my insurers to see what had happened, unknown to me, my payments hadnt been comming out for 3 months. I had also had a fraudulant act in my account that took me over drawn and bank charges hadnt helped, however that has been sorted and i have been re-funded. My insurers sent no notification of this, so i took out a new policy straight away and produced these at the station. 1 month later i have a court order, i plee guilty as i was driving without insurance (unaware) and sent a letter stating i would never intentionally do this as driving is my career, my living i already had 3 points for speeding, they gave me 8 points and £290 fine. I have 11 points now. is this fair?

  1. Personally I would have gotten the bank and the insurance together and fought it. That way when I went to court I would have had proof that it wasn't intentional.


  2. You're not going to like this, but it is fair. It's indisputable that you were driving without insurance, which is a serious offence in view of the risks that poses to others you may have collided with.

    Look at it from the court's point of view. They will have found it difficult to believe that you didn't know what was happening on your bank account and that the premiums weren't being paid - it's your responsibility to ensure that they are.  Nor will they believe that the insurers didn't tell you - they always do.

    It's a common ploy for people to take out insurance, receive the certificate and then fail to pay the premiums, and they courts are fed up with this and no longer interested in excuses.

  3. seems a bit unfair when you read about people who are already banned and driving without tax, mot or insurance who only get A SILLY FINE and a few more months ban

  4. there are two perspectives,1st like you said you were driving uninsured.guilty!,the other is if by chance you were involved in any kind of misshap the other party,s and you, had no cover,disaster!.the paper pushers are not interested in the least about your bad run of luck,which is not only unfair but really sad.the fact everything is based on money and taking as much as possible at every turn, and ignoring legit circumstances,so my answer is NO this is not fair.

  5. I'm sure you can contest the court ruling if you go and see a solicitor with proof of what you are saying you should be able to have the points removed. it looks like the courts made an example out of you . your points were high as was the fine.
