What happened as a result of not signing the arbitration agreement?

  1. Very interesting item and one that likely requires some research in your jurisdiction.  First of all, does the state (and/or medical licensing board) allow a doctor to attempt to contractually limit their liability by forcing arbitration.  Such agreements are often upheld between private parties but to demand such a thing from a medical patient smacks of "duress" (forced signature under threat).  I personally would be very hesitant to sign such a document, which would seem to limit my rights to sue if the doctor committed malpractice.


  2. No and have never been asked to if I did I would walk out

    Remember we hire them as a doctor so we can "sack " as fast.

    It would make me very suspicious as well

  3. Well, I'd HOPE that the doc wouldn't take me on as a patient, if I don't want to comply with his terms!  And I'd hope any doc I insure, would turn down a patient who wouldn't sign that agreement, especially if I was giving them a discount on their malpractice policy for requiring it!

    A doctor doesn't HAVE to treat anyone, unless it's a life threatening emergency, or you are in hard labor.  That's what the law says.
