Question:

Have you recieved your stimulus and filed injured spouse?

I filed my injured spouse form back in Feb after I filed my tax return. I received all of my refund as my husband has no income. I got the letter saying they took all of the stimulus and then called the IRS May 12th and they said they would do a referral. I realize I will only get half of it back, thats fine with me. At first I was told it would be 30 days, then after 30 days they told me to give them until July 1st.

I am wondering if anyone else who has had to have a referral done for the injured spouse & stimulus claim has received their check yet?

Thank you.

  1. The good news is that yes, a lot of people who filed the injured spouse form have already gotten their 1/2 of the stimulus.

The bad news is that many haven't.  If a clerk starts working on an injured spouse form now, they manually put the stimulus in first and kick out 1/2 of it (direct deposit if they can) and then work on the regular allocation.  The problem is, many of the forms were fully processed before the rebate program was written and no one coded the the rebate program to look for a completed injured spouse form and automatically split the rebate in half.

Consequently someone or something has to review the forms already done and process them *again.*  You just know there will be accounts that fall through the cracks.  One hopes this is will be automated, but who knows.

For anyone who can't wait on the phone, I would send in a 2nd 8379, put stimulus at the top, sign it and skip part II (the income breakout).  This would be a sure fire way to get their attention, but would still take 60 days.
