Having J-1 visa, trying to travel and come back after my expiration date?

have a J-1 visa that is valid until Christmas (and another 30 days to remain in USA) and I am thinking to travel to South America around early DEC and come back to USA (for traveling for 2 weeks) on 12/26.I was wondering if it is possible for me to come back to USA on 12/26 using a visitor (tourist) VISA although I have not yet went back to my country, but only to Peru. And if this is not possible, would I be able to exchange flights in USA on my way back from Peru to my country??

  1. As you said, you were admitted for the duration of your program as stated on form DS-2019 plus 30 days during which time you're allowed to travel around the U.S. and prepare to depart. If you choose to depart to Peru, that counts as your departure.

    Upon your return, you will not be admissible as a J-1 because your program will have ended. You will need to apply for admission as a visitor, either using a visitor's visa or under the VWP program. If you have a VWP country passport, you can pass through the U.S. as a WT visitor for pleasure.

    If you are from a VWP country, you can use the VWP to enter the U.S. after your trip to Peru if you can prove that you are on your way back to your home country.
