Question:

Having an item replaced under warranty? Replacement is refubished?

I recently sent a remote control back due to it being defective.

I received the replacement a few weeks after. I was disappointed to find that then sent me a refurbished item instead of a new one as they have led me to believe. Looking back at my records, when i asked if the replacement would be new, they have not directly answered the question, only addressing the fact i would received a replacement soon leading me to believe so.

Oh well I thought, as long as it works. Unfortunately it didn't. The remote had the same problems i had on my first one to a lesser extent. Worst, the motion sensing (its also an air mouse) feature was a bit wonky. To add some of the buttons were sticky.

My question:

1. Is it normal to replace a defective item with a furbished item?

2. What do i do now? I can send it back while the postage is at my expense and get another refurbished remote but i dont want to deal with the possibility of another defect. How can I request a new replacement?

  1. well its up to them to decide wether to send you a new one or a refurb.. a refurb is almost like a new one.. its sent in to get fixed so its fixed, like new....

    directv replaces their receivers with refurbed ones.. all 6 i sent in.. but as long as you get one back its good right?

    call them back and see what happens..


  2. Check the Commercial Codes for your State. Most State's laws give you the right to a refund if a product is defective, or if it is misrepresented. Other than those two reasons, it's usually Caveat Emptor. (buyer beware)

    Know your rights and you're more likely to get what you're after, in this case, a "new" replacement, not a refund. Easier for them, better for you.

  3. 1. no, they should replace it brand new one

    2. a. report it to customers protecting program, ask for they advice.

    b. send it back, you are not junk yard, you are customers that have right to have satisfaction of product you have buy.

    c. record the serial number of product you have returned, and compare it with others you have back.
