He wants to see his kids. Can he?

My friend Levi was on a trip for three weeks. His ex's sister planned the whole trip out. Now he went on his own but then turned around and she asked him to take her two oldest kids so he did. After three weeks he came back and his girlfriend at the time had sold most of his things. She left him for another man, wont let him see his kids, and put a restraining order on him. He can't see his kids now because of her and it is killing him. What right's does he have for those kids? And what can the grandmother do seeing as how the mother wont let her see the kids either?

  1. Why has she took a restraning order out if he went away for 3 weeks.

    I would see a solicitor it will cost, most solicitor offices do legal aid on a saturday morning, i would ring a few in the area and get some advice otherwise their isnt a lot he can do really.

He needs to take the woman that sold his belongings to court to recoup the money.  It is illegal for her to do this.  He needs to go to court for child support/visitation and get a court order to see the kids.  Grandparents have absolutely no rights concerning grandchildren unless they have custody.

  4. depends on the circumstances. i don't think she can get a restraining order without some sort of hearing. he'll be able to work it out but it's gonna be hard and he'll need a lawyer. if he can prove the stuff she sold was his a good first step could be prosecuting her for theft. if that flies she'll end up in jail and the kids will be his. unless she's somehow managed to get his rights as a parent revoked, in which case they'd go into foster care, which would be bad. he needs a lawyer.

    the mother cannot keep him from seeing his kids unless hes abusive towards them and she can prove it..

    he can get court ordered visitation rights and when he gets the kids the grandmother can see the kids too

  6. Well, the first thing this man needs to do is go to court and explain the entire situation.  He can't confront his ex due to the restraint, but going to court will let him have some sort of say.  

    Now, why is it that a restraining order was filed against him?  What was his crime?  

    It's going to be extremely difficult to gain rights immediately since the restraint is filed against him, but if he works hard at getting a good attorney and defense, in time the order will be filled and he will  be able to see his children.  

    What might happen first is that he will have visitation rights, but he will  not be allowed to be in the presence of his ex, so she will have to drop them off at a center so he can see them.  It's better than nothing.
