Hello all-?

I just got in an accident with my 4 children, and do not want a lawyer involved. I had the 1/3 thing, how can I do this myself with the insurance company to make them pay. They want to give only $5000 plus pay the medical. We were all swollen and cut, myself and daughter more than the other. We were transported to the ems but what will the insurance pay without an attorney. Is it wise to go and just get on. I know we'll be fine and I have insurance to pay for the bills, so what now?

  1. Was the accident your fault?  Or the other drivers?  if you were at fault, your policy will generally pay the medical payments limit out per passenger in the car, this limit is most commonly $5,000.  If this was the other persons fault, then their insurance will generally pay for medical bills and the cost to repair/replace your vehicle (whichever is cheaper).

Are you looking to get more money than would be paid for your medical bills?  Were you out of work due to this accident?  Did you suffer some kind of financial loss other than your car being damaged and your injuries?  If you answered no then you are probably not entitled to any other compensation.  A car accident is not a way for you to make a profit.  Be thankful your children weren't injured worse than they were and go about your life.  Get your car fixed and your medical bills paid for and move on.  That's what insurance is for ... to get you back to where you were had you not had the accident.

Good luck to you and I'm glad to hear the children are not seriously injured.

  2. I honestly would get a lawyer cause 5k is nothing compare to what you will get. Also you may all seem fine right now but in the long run you will feel back pains. If you don't want to worry about lawyers and the long wait just take the 5k.
