Help, I'am getting wrongfully sued??

I was riding my racing bike yesterday early morning. There were only a few cars around and very few people around. While i was cycling downhill, i saw a lady and her son walking past.

To my great surprise, the lady pushed her son in front of my bike. I stopped and went to see what the h**l happened there. Her son suffered a minor head injury and the next thing I know shes sueing me for £15,000!!!

That lady pushed her on son deliberatly in front of my bike just so she can earn some quick easy money!!?? What kind of society do I live in?

What kind of injustice is this?

  1. Unbelievable, i'm curious to know how old the mother and son are.  It's just too early in the morning to think of a mother doing this to her child, I'm glad you weren't driving a BUS...


  2. Sounds like she has her lawyer on speed dial!

    Only thing I can suggest is to see your own lawyer and take advice.

    This might be the new version of cars bumping you into the car in front, then all claim whiplash injuries.

  3. I see this happening a lot these days, people are trying to sue anyone and any company for the most stupid of this.

    I did read about a women taking Marks and Sparks to court because she tripped over her 'own' son in one of there shops.

    As pointed out the UK is vast becoming a bit like the USA, everyone wants money for nothing basically, however it's probably better if you do get hold of some advice as you just never know.

  4. LOL!! rest assured that women is deluded and watched too many American programmes.  I think it is highly unlikely you will be sued for £15,000.  when i studied tort, I was told it was only about 11.7% of cases that actually succeeded, so much for " where there is blame, there is a claim"

    It is not so easy to sue people in the UK so don't worry.

  5. E>U justice I'm afraid. As E U law now takes precedence over national law there were a few changes relating to cycles. If a cyclist is injured by a car driver no matter who is at fault the car driver is responsible. Likewise if a cyclist injures a pedestrian ,no matter who is at fault,the cyclist can be sued. What are the chances that the mother is Roma, I have seen cases where young babies are given washing up liquid to make them ill in order to facilitate begging so shoving  your son under a bike is small beer. I would let them take it to court and demand a jury trial. Someone has to take back our legal system.

  6. get a solicitor onto it and go to court. Also this should have been reported to the police. And unless hes been severely injured and will require constant medical treatment I doubt she would win an award like that

  7. A very unjust one if she gets away with it.

    She'll probably try to bully you into giving into a smaller amount to avoid court - do not give in.  Do not give them a thing (some people might be tempted to give her son a packet of sweets or something, depending on age, as they feel awkward) as this could be seen as a sign of guilt.

    Seek legal advice and see her in court if thats what it takes.  At that point it wouldn't surprise me if you find out that she's done this kind of thing before and may even be a vexatious litigant.

  9. You did immediately report her conduct to the police ,of course,and then you should sue her for any damages,i,m sure you can think of some,consult a solicitor,but on no account succumb to this moral blackmail.YOUR CHOICE.
