Help, I am a renter of a property that seems to be in foreclosure

I live in Peoria Arizona. I lived in my new rental home for a month. I have had many clues leading me to believe this property is in foreclosure. And my landlord agency tells me different stories about why the bank came to the door trying to lock me out. Where do I go for public records for foreclosure? Can I sue the landlords for moving expenses? What am I to do? I could just cry....I just enrolled the kids in the new school, and I don't think I am mentally, emotionally, financially capable of moving back to back. Where do I start, what do I do? I'm being strung along and lied to, worried everyday if I will have a place to live the next day. Please help.

  1. Email me privately I will help you look it up.

I have worked in Title and Escrow for many years here in Maricopa county and have also worked in foreclosure dept. I can help you look it up

!st you have to see if there actually is a notice of trustee sale and when it is. If there is Don't pay the person rent anymore. What are they going to do sue you. kick you out. They are going to do that anyway . You could sue them for moving expenses but they don't pay the bank do you think they are going to pay you.

You need to figure out whats going on 1st before you do anything.

  2. Dont Pay any more rent your being had, If you have any deposits ,You can hold the agency responsible, They knew what was going on, Contact the realestate  board if the agency gives you a hard time,This is happening all over,If the bank comes tell them you are willing to pay them the Rent sometimes they will go along with you, GOOD LUCK

  3. talk to the bank about purchasing the home when they foreclose.

  4. If you have a lease you are guaranteed your right to live in the house for the length of the lease, at least in most states.  You may be able to get confirmation from the local Board of Realtors or State Department of Consumer Affairs. Be sure to pay your rent and get a receipt.

If the bank continues to hassle you threaten a small claims action or to report the realtor to the Arizona State licensing board.

    Good luck.

  5. Google up like this

(Your county) Arizona Clerk of Court Public Records

  6. I live in michigan and am going through the same problem. I found out because the bank left a notice on the door. Of course my landlord will not return my phone calls. Laws may be different in AZ, but what I did was call thebank. They let me know that indeed my house was in foreclosure. What would happen is from the sale date the landlord has 6 months (since the house is occupied) to redeem house. If the house was not occupied he would have one month then they put a lock on the door. Which leads me to believe if they are already trying to lock you out, then he rented under false pretenses. Now, the bank told me if he does not redeem the house within 6 months from sale date then the bank would send me a notice to get out of house. They said they give you at least a month sometimes two. I'm sure you would have cause to sue but what I read is that I'm probably out of my security because the landlord will probably claim bankruptcy. I found alot of information just by google'ing rental under foreclosure+michigan and found a website to let me know the legalities. Call the bank immediately to find out what is ecxactly going on. If you are not sure of the bank look online for city or county records. In one of these gov't sites should tell you who owns the lease on the house (these are public records) or go to the buildings themselves and talk to your city clerk. I hear this is happening all over the US and their is no penalties to the landlord. Write your governor and demand something be done about this epidemic. Try going to your local Social Service office. I called to se if I could get help for a new down payment and sec deposit and they said they would take the foreclosure notice the same as an eviction notice and I could apply for emergency assistance. Good luck to you.
