Help! I have people at my school changing a disabled child on the bathroom floor!?

I have a child in my class who has to be taken to the bathroom and has to have help removing and putting on her prothesis. The people who are doing this are doing it on the public bathroom floor! I have complained and they are continuing to do it. I am looking for a law that states that this is against the girls rights. Anything in IDEA? Help me help this child!

  1. What about talking to the parents? See what their take on this is. Also they will know who the child's advocate is, and can contact the advocate. (She should have one). The child's advocate is state assigned and makes sure that things are done in the best interest of the child. I think the parents will be able to accomplish far more than you can, and won't be risking their job to do it. The child's advocate will be able to accomplish quite a but too. My sister has Downs Syndrome and we were going to a gym. Another person that went to the gym kept on harrassing her in the locker room. All I had to do was contact the manager, and tell him that my mom was contacting her  advocate if something didn't change. The woman's membership was revoked. You do have to be the legal guardian to get the advocate involved, so I think the girl's parents is your best bet.


  2. I don't know who you have reported this to but the first 3 people who should be notified are:

    1. The child's parents

    2. The school system's superintendent

    Report this both verbally and in writing..documentation is essential. Add that you have reported this before to no avail.

    Not sure where this falls legally.Under IDEA the law calls for a "free and APPROPRIATE education". THIS is FAR from appropriate. Advise the parent's that if this is not IMMEDIATELY rectified they can ask for a Mediator (who must be unbiased, unemployed by the school system and paid for by the school) who I can ensure you will stop this behavior. I am willing to bet the minute the school system hears the word "mediator" the behavior ceases as mediators are quite costly. This is a lawsuit waiting to happen and I personally, am appalled. Good for you for not putting up with it!!!

  3. I do not understand why you have not reported this to family services or the health department. There must be a disability advice centre. Are you afraid to lose your job. I would be contacting the department and not give up until someone does something. If you were a patient in a hospital and a nurse tried to put you on the floor to give you a wash because you were too sick, you having a voice would yell loud and clear and that person would face severe penelties.  Please be a voice for this child.

    and what do you mean in your class

    if you are a teacher you are in charge of the child

    so demand they stop what they are doing right there and then otherwise you will seek the help of police to make them stop,meantime find out who these people are exactly and who these people are employed by and Demand to speak to their superiors or bosses about their  company/agency and its current "wrong" practice/policy when working with children

    make it clear you dont agree with it

    and whats more you arent going to just put up with it either!and inform the childs parents/guardians also

    It is a VERY busy board with LOTS of knowledagble parents who can and will be glad to help!

    They know IDEA law very well!!

  7. You should be reporting it to the child's parents and the school board if you cannot get the principal to listen to you.

    If she has to be changed in the bathroom, she should at least have a clean rug or mat to be put under her while it is being done.

  8. Hi, I have a younger brother who is physically diasbled. From what you're saying, it seems like the school is not equipped for that child. When my brother was in elementary school, they had a bathroom specifically for kids in a wheelchair (of course only one disabled child would be in there at a time). There would also be at least 2 E.A's (Educational Assistants) doing two-man lifts and such. There was a bed they would lay my brother down on and it could be adjusted to go up or down so the EA would be in comfortable reach. The size of the bed was basically a single. In NO way should they be putting a child on the floor, it is not not good for them.

    What I would do, is talk to the principal and parents, and if this continues, go to the school board because this is unacceptible. if worse comes to worse, and this is still happening, I would advise the parents to transfer their child to a different school that is equipped, more caring and careful.

  9. can't do about it, the child is already disabled and you don't want anyone to help the child? why don't you do this? ask the child's parents to hire a maid to help her on her problems. why doing a useless research on finding a law to keep the people helping her in jail?  you are already an adult and you can't make a simple decision?

    put it on the floor for her

  11. dude, thats not right what they are doing... try telling a responsable adult or calling the police
