Help! Insurance liability question?

I have my boyfriends car registered in my name (stupid I know) because he doesnt have a license and was unable to register it. There is liability on the car only. If he gets in an accident (his fault) would the liability insurance that is on the car cover it if he doesnt have a license?

  1. You can believe the stories about insurance following the vehicle and not the driver, if you want. I have lived in 3 States and the insurance was different in each. The kicker is, the insurance would not cover an unlicensed driver since they are violating the law. Only way I have seen this covered is if the vehicle was stolen. No matter what the insurance covers, you and your boyfriend will be in court and you will probably lose your license. You will also be repaying the insurance company. Good luck finding insurance you can afford after this happens.

Liability coverage follows the vehicle, not the driver.  So he should be covered.  However, if the insurance company determines that he is a regular user, they MAY deny coverage.  In some states, the insurance company cannot deny all liability coverage.  They have to cover you for at least your state's financial responsibility limits.

    I think you should run this question by your agent for the best answer to your question.

    You also need to consider the type of person you have chosen as a boyfriend...   Tell him he needs to man up and grow up or he's gone.

  4. bigger question...in whose name is the insurance?   if he wreck someone elses car/hurts them...they can probibly sue...both of you

Your policy probably states that if it was reasonable to assume that he had your permission to drive it, then he (you) might be  covered.  BUT....   if you  permitted him to drive knowing that he was not licensed,  your insurance may not cover anything.   If he gets into an accident , he and you are going to be in major trouble.  He may end up in jail,  you might be liable for the costs of the accident . . . wrecking your credit and life for the next 10 or more years.   At the very least, you  will be probably be dropped by your insurance company and be forced to buy insurance elsewhere for many thousands more than you pay now.   It's really a bad idea to provide a car for someone who is not legally permitted to drive.  You could end up paying for it for a very long time.

  6. OK, so it's titled to you, too, right?  

    If you didn't list him as an operator on the insurance policy, and he operates it, your insurance company will deny the claim.   If the car is titled to him, and insured under you, you have no legal interest in the car, and the insurance company will deny the claim.

    Worse, if it IS titled to you, and you have minimum coverage, and he causes more damage than you have insurance on the car, YOU get to write a check for the difference - or have YOUR wages garnished.
