Help Plz!! I need to know what to do!?

Apparently a friend of mine (a girl) had her visa either expire or get really close to it. So she went around asking to marry her guy friends to be able to stay in the country. She was able to manipulate one of our guy friends and he actually did it. I need to know what I can do. Is their anyway to help him? What will happen if they are caught? I'm worried because they haven't even tried to make it seem like a real marriage. They married sometime in Feb. of 2008. If anyone could help in any way it would be most appreciated. Thank you for your time.

  1. She is looking at automatic deportation and he would be looking at a fine of $250,000 and/or a prison term up to 10 years if they are caught in a fraud marriage.

    Just by getting married does not give her automatic permission to stay in the country. They will have to file for her to become legal and prove they are in a real marriage. They will be interviewed separately,probably more than once. They will be asked the same questions and their answers have to match. They can come to their home to prove they are living as a married couple. They'll need a joint lease agreement,bank accounts and bills. They'll be asked about how they met,how long they were dating and will want pictures of the two of them together.

    I think your friend got himself into something that is going to be nothing but trouble for him. He needs to get out of it now.

  3. I really do not understand what you're asking.

    Do you want your friend to get out of the marriage or do you want to help make it work for immigration purposes.

    All he has to do now is move in with her and have it look like a real marriage. He can petition for her so she can get her status adjusted, and it will be over in a few years.

Even if she got married, she has to apply for a change of status on her visa and to claim they are married, they have to be able to show proof of the marriage: co-habitation, joint bank accounts, joint bills, pictures of their relationship prior and since the  marriage.  They are in a very risky situation that may not turn out well.  USCIS frowns on fraud for the purpose of a visa/green card and deals very strictly with it.

  5. There are now severe penalties for what she is doing and this law is finally being strictly enforced. Not only is she looking at what will probably be jail time your friend could also be arrested for conspiracy to violate US immigration statutes. There was a time when illegals who violated this statute commonly got away with this-no more.
