Help a problem with Ebay and item?

I have a problem,

I purchased a movie from ebay I payed with paypal, it has been over 3 weeks and I still have not received the movie. The other thing that I am a bit angry about is that I have sent the seller 3 messages and the seller has not yet replayed to any of them. Now I just wont a refund. What can I do to get a refund.

put in a dispute through Ebay, three weeks is long enough. Also put in a dispute through PayPal.
