I am in US on H1B and I have been married for over 1 year. My husband turned a citizen last week. I dont want to hire an attorney and I was hoping I can do this myself but I am not sure which forms and how to go about this. Any help will be appreciated.

Thanks

  1. I also came to the USA on and H1B visa and married a citizen, we filed for our greencard last Dec and I received it in April.  I have copies of everything we submitted (I used a lawyer) so email me if you have questions... all the forms you will need can be downloaded for www.uscis.gov.  One quick questions, when is your H1B valid until? I it is valid until after your 2 year wedding anniversary then I would hold off applying until then as if you apply before your 2 year anniversary you will get a conditional green card, and have to apply at your 2 year anniversary to have the conditions removed.

You will need to file the following forms:

    I 130

    I 485

    G 325

    Optional:

I131 if you want travel permission, but I think you can still travel on your H1B during your green card processing

1765 if you want to work for someone other than your current employer whilst your green card is processing

You will need to file tax returns for your husband, and all sorts of docs to prove your relationship is valid.

Like I said, if you need help email me - I have copies of all my forms.

    Good luck - Sarah :)

  2. It's really easy if your situation is legal and you're on a valid visa, which I understand you are. Indeed you do not need an attorney.

You'll want to read this guide: http://www.visajourney.com/forums/index....

It will explain everything you need to know with step-by-step instructions on how to assemble your application.

  3. Adding to Sarah's info

Just file I-765 and I-131 with I-485. The filing fee of I-485 $1,010 includes all the filing fees. Good luck!

  4. Go the USCIS website and go from there.  If you cannot follow this, then maybe you should get a lawyer.
