Help i'm being sued?

i was in a car accident 4 years ago where i was driving a uninsured car and cause the accident. the other guys insurance company is now suing me. for over 20,000. i don't have that money nor do i have any for a lawyer. right now i'm a stay at home mom with no income and we r barely surviving on my husband income. this accident took place in another state. and i don't even have the money to go to the court. i'm look for someone who are or where in a similar situation. what are my options what r they going to do to me if i don't pay. please be serious. i was in this accident when i was young and had no ideal that there was no insurance

  1. You need to talk to a lawyer who specializes in auto insurance cases.  Sometimes a lawyer will give you a free 15 minute consultation.  That is what you need to look for, but you may have to go fora scaled service in your city/state.  

    Since you had no insurance every cost of the accident is being charged to you.  Legally you have the burden because you broke a basic law of most states.

    What you have to do is sort out the charges and make a deal with the insurance company.  The longer you prolong the negotiations the better deal you tend to get, but generally people cave or get hysterical and almost die of worry.  Quit worrying, it isn't going to help.

    A lawyer is needed, the sooner the better.  Ignorance will not be a good defense.  Instead every charge needs to be questioned.  Why they are charging you that amount needs to be established and how they came up with their figures needs to be delivered to you/ and or a your lawyer.  also, you need to figure out why they waited so long.  they could be counter sued for trying to rack up unneeded expenditures.  Especially if they always knew where you lived and you can prove that.  

    Since your lawyer will be putting in a bunch of time and not expecting any settlement from the other company, it will be hard to get anyone to do this for "pro bono" or for free.  But try to get one to do it that way if you can.

    I was involved in 3 accidents with uninsured motorists.  One of them was supposed to go to jail because it was his third uninsured accident.  I felt very bad, but needed to get my car to go to work and support my kid.  So I signed over my rights and the insurance company went in like sharks, charging for their time as well as my damages.  But it took 7  years and the guy finally got a lawyer and worked out a settlement.

    So get a lawyer and work it out.  The insurance companies charge off uncollected amounts all the time and take it out of the tax they owe our government thus increasing their profits.  And  they can use losses to just raise everyone's premiums, so they really do not care about doing things economically or using common sense.

    This is why you need a lawyer.  On some items a counter suit may be called for.  I do not know your particulars or the states involved.  If the suit is taking place in another state you need to get a lawyer in that state probably.

    There's a bunch of "free" services on the web.  Check them out before you even consider using their sites to find a lawyer ...because you will be giving them your personal info and that of your family.  If you cannot find them in a phone book or if they have no physical address you can check on Google, have nothing to do with their site.

  2. Search online for free legal aid in your area. A lawyer will better be able to show you your options. One thing to consider is that, since you have no money, they can't really get any money from you, even if they win. Worst case scenario, you end up having to file bankruptcy.

Are you sure about that date?  The statute of limitations for this type of lawsuit is typically two years, three years in certain circumstances.  First thing you need to do it check your state's statutes to find out what the statute of limitations is.   If it has run then you can easily get the case dismissed.  

    You might call your state's bar association and find out if they can refer you to a lawyer or group that provides pro bono legal services (that means you don't have to pay).

  4. They cant squeeze blood from a turnip!  If you dont have any assets then what will they take??  First of all, it the accident was 4 years ago then the statute of limitations has run in most states.  Most states say the claim must be brought within 2 years.

    Every state has a Legal Aid department. Contact your and ask for assistance or get an attorney.

  5. My advice is to go to the citizens advice or get legal aid. You cant hide from the courts but if you get legal representation it will help your case. you may get a community sentence as you have no money or assets. Good luck

  6. Did you have insurance when the accident happened (forgetting about the uninsured car) ? If so, tell them and they are the ones that should defend the suit.

    Also check the statute of limitations in that state and in your state, the insurance company might not even be able to bring the suit.
