my rental car was taken by my boyfreind and drugs were found in them when the police stopped him what will they do to me i was at home and the rental is in my name

  1. If your boyfriend was not an authorized driver of the rental car (either by separate agreement with the rental car company or specific contractual inclusion ... as in a clause that states that domestic partners are automatically included as additional drivers), you have two separate sets of problems.

    First, it appears that you have a boyfriend that uses, sells, or delivers illegal drugs!  Any chance of him storing drugs in your home?  Second, the rental contract may have been violated.

    The specifics of the first problem are easy to see.  If he "gives up" his current stash for a deal, and that stash is in your home, you just bought a piece of his problem.

    The specifics of the second problem are a little harder to see.  You will owe the rental company for all towing and impound fees.  The rental contract will not be closed until the car is back in the possession of the company (you will pay the company it's rental fees for the impound period).  You will most likely be blocked from renting cars from that company in the future (most rental companies have a "do not rent list" that includes renters that allowed unauthorized drivers to use the vehicle, or violated the contract in other ways ... such as allowing the car to be used for illegal purposes).

    Potentially you could have some very big, expensive problems!

If the police contact you, say "I don't want to talk to you, I want to talk to my lawyer."  You need to just repeat that over and over again.  All calls from the jail are recorded.  Do not accept calls from your boyfriend.  Again, do not speak with the police, do not try to give an explanation.

  3. Nothing. You need to go get the rental from impound, I'll bet.

  4. Legally, nothing will happen to you because you weren't in the car at the time drugs were found.  The car was more than likely impounded & you will have to pay to get it out.  For your own safety (& criminal record), you should seriously reconsider your relationship with your boyfriend.

  8. You shouldn't be in any legal trouble as far as the drugs are concerned.

    As for the rental car, it depends on where you live, and your local laws. Where I live, officers are allowed to seize a vehicle in this situation. In that case there is a possibility that the owner will never be able to get the car back. That is the worst case scenario. Best case scenario is that you will need to pay a tow or impound fee, and get the vehicle back to the rental company.

  9. as long as you didnt know about the drugs and you were not in the car so they cant blame anything on you as long as you didnt know there was drugs involved
