Help in getting full child custody. ?

My brother is having problems with his ex, by her not taking care of her daughter and he would like to have full custody of his daughter. But she keeps harassing him telling him that she will leave the country. HOw can he take control of the situation?

im afraid the only way he can legally get custody is to present a case in court against the mother, proving she is unfit, and that the father is capable of providing a home. does they share joint custody, or does the mother have full physical custody? if its a shared custody, and she leaves the country, she could be charged with kidnapping

he needs to take the child and get a lawyer right away and file for full custody in his area. He really needs to get a tape of her saying she will leave the country with the child as proof of the child's safety. He needs to keep every little note on what happens, record all phone convos and better have some money cause it's not cheap.

If there is no order of custody he can take the child for a visit and does not have to return her.  My brother went through this when he got divorced.  If there is a custody order you have to do what it says until you can get to court.  I suggest that your brother gets a good lawyer.  Unfortunately, neglect can be hard to prove and the courts still favor the mother.  Good Luck.

If he can afford to get an attorney that would help, if he can't maybe he can go to legal services that cater to lower incomes.  documentation is key, dates, times, behavior, reaction by child.  go to the friend of the court and speak to a social worker.  if she's threatening to exit the country with the child, unless she does it illegally, she cannot without the other parent's consent and passport.  this is where he may be able to buy some time.  tell him that under no circumstances should he sign anything.  best of luck.mm
