  1. This sounds like a question on a law exam for torts or criminal law.  Baxter may be guilty of both a civil tort and a crime.

Let's say the merchandise was worth the minimum in your state for a felony.  In most states, there is the "Felony Murder Rule".  This means that if someone dies in the course of felonious activity, that person is also guilty of murder and may be prosecuted on that count as well as the original felony.  Research this online for your state.  You'll find upteen legal cites.

In civil court, Baxter could also be tried for several torts, including an unlawful death action as well as the original assault and the running by the victim might even qualify for the elements of battery.

If Baxter is found guilty in both criminal and civil courts, he could end up both in jail, and owing money to the victim's family.

There's plenty of cites for all of this online.
