my boyfriends ex is taking the his 2 kids to los angeles shes doing this for a guy from prison she ran off with and got forced to resign we currently live in central ca he is really devastated what can we do legally he currently has his 13yr old living with him whos gonna stay with him...

  1. Is there anything in the custody agreement stating that she can't move out of a certain area?  If not, then she's free to do as she wishes.  


  2. She can do anything she wants except what the child custody agreement explicitly says she cannot. Same for him.

    For most cases, as long as she's not taking the children out of the state, there's legally nothing he can do about it. He would have grounds to revisit the custody arrangement, since I'm certain his visitation capabilities would be impacted by this (assuming she has primary physical custody).

    His best bet is to speak with the court judge and ask for a hearing on updating the agreement on custody and visitation (and child support). Also, if the guy from prison is living with his ex, he could express concern about the welfare and the safety of the children (depending on the crime).

  4. well i live in new york and i know my friend told me his ex wanted 2 move to pa.. but she couldnt bring the baby wither her unless it was for the baby... and it wasnt so she wasnt allowed 2 move because the father had visitation rights... but i also hurd if you make a certan amount that they will tell yah *** 2 fly there evry weekend if u reallyw anna c ya child which i think is bullsht...

  5. If she has visitation rights there is nothing you can do. If he has custody and she refuses to bring him back then it is kidnapping. However there is no law that stops either parent from taking a child anywhere in the state. The law states that you can not take a child across state lines without the other parents permission.

    All you can do is notify the police if you feel the child is in danger of some sort.

    Say if the inmate was in for child abuse.
