Help! my boyfriends boss just took out his paycheck from our bank!?

They got into a spat and my boyfriend quit and got his last paycheck last week.

He has direct deposit and when i looked online today it showed we had negative 500 and next to it it said "direct deposit reversal"..who do i talk to about this?

His boss doesn't have a boss ( he's a fed ex contractor) would he go to HR? I already know the Managing Director of the warehouse can't reprimand him, so who can?

  1. The first thing to do is understand why the reversal was made.  There may be provisions in your boyfriends employment contract that allow this reversal.   So I would contact the payroll person that is responsible for producing the direct deposit and ask them what is going on, then proceed from there where that information takes you.

He should talk to his former boss first to see why.  It may be because the check amount has to be adjusted for hours not worked and/or because he's waiting for uniforms or other company property to be returned.  Employers are generally allowed to keep a last paycheck until property is returned.  If that isn't the case, then your boyfriend should go to Fed Ex HR.

  3. Contact the Wage and Hour Board in your state.  Usually you can find this number in the Government section of the phone book, or you can call your local employment office for the number.

    He doesn't legally have the right to with hold or reverse any wages paid.  You should seek legal help through the wage and hour board, or local free legal aid (www.lsc.gov) I work for legal aid in KY but the above website will tell you how to contact a legal aid program in your state.  First go to the state, then locate your county or the biggest county close to you and call them.  They may have what is called a Central Intake or Hotline advice line you can call and get immediate advice about what to do if this causes over drafts on your bank account and how to file all the claims, etc.

  4. Most states have an employment security commission. I have facilities all over the US. In most cases, you must pay the last check with in 3 to 5 days and fight any disputes out in court. Check online with your local ESC. They will send your boss a letter on your husbands behalf.
