Help on laws really need help?

im 17.. living in michigan with my aunt.. ive been here for 1 month... i will be 18 october 11.. my parents are in ohio split and in the middle of a divorce.. my mom was living here but she moved out and left me here. now my father wants to come get me 2 live with him but i dont want to leave with him.. can he bring the police here to take me?

Yes, if he really wants to push the issue ha can compell you to "come home".  You need to explain to him that you love him very much, but you are staying right where you are, and if he forces the issue, it will do irreprable harm to ya'lls relationship.  Always be the bigger person and stay above the fight.

  2. Yes, until you are 18.  You could try to become an emanicipated minor, however that would probably take longer to process than just waiting for your b-day.  You can't try reasoning with your father?  You are almost an adult, and maybe he will realize that?

Well unfortunately until you're either 18 or legally emancipated you have to comply with your parent's wishes.  I doubt the police would show up and force you into the car!  Your aunt has hardly kidnapped you, right, and you're not in a cult or anything, so they wouldn't be able to really force you to go.  But legally the only way around it that I see would be to contact your mother asap and have her get a petition in front of family court to stop your father obtaining sole custody of the minor child until the judge hears the case.  Then he would have to wait until the hearing to be able to call the shots.

    Sorry you're going through this, hon, it will get better.  Go sign up for some classes at the local community college today... if you're attending college there where your aunt lives the court would be less inclined to make you leave.  And college is a good thing.  :)
