Help please! i was in a car wreck they cited the other driver not me , i need a rental car ,her insurance?

company said that their client told them i got cited which is a flat out lie, what should i do? oh , they also said that they was going to pay for a rental just as soon as they got the ladies statement that was before i got the call about me getting cited

  2. If the other driver is in fact at fault then send the police report to the insurance company. That should clear the air. Once you clear up that issue the other drivers insurance will cover the rental car.  Don't get your company involved if you don't have to. You can file a claim with your own carrier and let them subrogate but they will charge you your deductible until they get the money back from the other drivers insurance company. Try to work with the other drivers company on your own as long as you can.

  3. This happens. Is the police report completed?  If so get a copy, fax it to the insurance company.

    Do you have insurance?  If so let them handle this.

  4. Ya know, it doesn't MATTER who got cited.  Police do NOT determine fault.  

    Clearly, her story and your story conflict - and she's making it sound like YOU are at fault.  You don't describe the accident, so no one here can offer an opinion.  

    Best thing to do, is put the claim in on YOUR insurance, including the collision and the rental car.  Then let your insurance fight it out with her insurance, to determine the fault for the accident.  

    If you don't have collision and rental, you'll have to try to sue her in small claims court.  And if you're at fault, you'll lose.

  5. You may want to use your own insurance company.  They will then do all  "contacting" and you won't have to be concerned with who may or who may not be at "fault".    As far as the rental, if either Insurance company won't provide one, find  a body shop to fix your car that will provide one.

  6. Go to the police department and get a copy of the report.  Then you can give it to both insurance companies...but remember, a police report is just heresay.  They are not at the scene of the accident as witnesses.  They take statements from all involved, witnesses if there are any and come to their own conclusion or opinion....(key word: opinion)

    You do need to report this to your own carrier for your own safety...why wait for the other carrier to determine fault when your insurance company can start on repairs right away?  This is why you pay a premium.  (If you have insurance coverage)

    Until they get a statement from their client and decide fault,you won't be getting that rental.
