I moved into a new house a year or two ago.

The people who built the house apparently didnt dispose of their trash like they should have,instead they buried it in our back yard.My son was running through the backyard one day and the ground fell in at one spot.I didnt think much of it since it was a small hole.But now the trash has decaded in the ground and now the whole get bigger and bigger and u cant step around it without the ground falling in.

Is there anything i can do about this because the company refuses to fix it.So what can i do???

  1. Go to city hall and have the permit on the property pulled. It should have all the sign offs on it so you know who did what on the property, while you are at it, file a complaint and show them pictures of the areas in question. They should help you in your favor because they will also be liable for signing off on something they shouldn`t have.

    Get a consultation from a lawyer in real estate, I`m sure they will be glad you did, especially if they see dollar signs coming their way. If they offer to accept the case for free, that`s your indicator you have a winner of a case, just don`t be disappointed if they end up with more than you.

    There have been many housing developments built over waste and landfill dumps, that's why your situation doesn`t surprise me.

First go to the Better Business Bureau and report them.  Then call your local Environment Protection Agency office and tell them what has happened.  Also call whatever licensing board in your area that handles contractors and builders and tell them.  The BBB really has no power to make anyone do anything, but if the company is a member, they'll want to keep their good standing, your best bet is the EPA and the licensing board.

  3. You have two choices, 1) either dig up the trash and fill it with rocks and sand.  A little at a time and flush with water so the rocks & sand fill the voids (holes) - then compact it.

    2) Or just keep filling it with with the rocks sand & Dirt

    I have same problem here in Florida so I tried #2 for several years - then I finally dug it up and filled it.

    I found a huge door and aluminum windows, pipe, cinder blocks etc...

Oh my god - the home builder is certainly responsible for this and should clean it up before someone gets hurt!  Maybe you should contact someone from your city's building department & ask them what to do - make sure you take LOTS OF PICTURES of the spot, and keep taking pictures as it gets bigger, etc.  You may need to hire a lawyer and have them on notice that you plan to sue them if it's not taken care of PRONTO!   Good luck!

Consider suing the original contractors or the agents, they have left the site in a dangerous condition and should put it right.  A threat of law can make some people change their minds suddenly.  Any letters you send out should have a hard copy filed away for future use.  Don't rely on a computer copy, just before you need it you will lose it.
