Help please with PA ARD Question?

So I made the cliche girl mistake of lending a guy money who is a complete loser. Currently he is being an *** about repaying me, but is about to enter the PA ARD probation program thing for a criminal charge. Given that ARD is only granted to those with no criminal record (and he has one they have not found because it is in another state), could I report him to the DA and have his ARD revoked? I should also mention that he is still using drugs (timed around his weekly urine tests) and continuing with the illegal activity for which he was arrested. Yes, I know I was stupid to lend him money, but at this point, I just want him to be as screwed as I am. It may be petty, but it is the only option left to me. Ideally, I would love to get my money back, and have multiple emails from him acknowledging the loan, so if anyone knows how to go about that, it would be greatly appreciated as well.

  1. Your loan problem is a civil matter, which means you could take this guy to small claims court to get your money back (and you could use the e-mails as evidence). It's not a criminal matter, so I doubt the DA would even be interested. And you don't have any evidence about his illegal drug use, so I doubt they would be interested in that either. They would probably think you were just bringing it up as a grudge against him because he hasn't paid you. My advice would be to go to small claims court and forget about the criminal stuff. You want this guy to get probation so that he can attend court and face you.
