A doctor administrates a high dose of pain killer drug to a terminally ill woman who dies several days earlier than what she might have done. what are the arguments for holding the doctors conduct criminal? and what are the grounds for substantive defence?

  2. Killing someone who is going to die is a criminal offence everywhere in the world. Even killing them a few minutes earlier than they would die is a criminal offence.

    Mostly the law looks away in these cases. Because it is not worth the trouble and anguish.

    This is different from assisted suicide.

    Defence could only be constructed around such things as the pain killer was administered as part of the palative care. The doctor has the duty to ease the patients pain etc.

    Many doctors have admitted to doing this sort of thing by the way. Could you stand aside and watch someone suffer?

  3. You need a real attorny in your state to answer the questions you pose.  You also have questions of fact that would require law enforcements participation.

    From what is presented here, the best you might hope for is a professional censor aganist the doctor, and that is not likely.

  4. Depends on if the patient asks for it! If in extreme pain, and knowing that she was going to die anyway, I would consider it an act of mercy. Nothing more, nothing less. If I was in her place, I would hope my doctor would have the courage to do so!

  5. High dose- but is it still within the theraputic range

    How can anyone (save for God) know when someone is going to die.  There is no medical way to predict such a thing to within days.  

  6. that's what they did to a friend of mine. his life patner successfuly sued and settled out of court for 1.67 million dollars. it was a blatantly obvious malpractice, the dr. ordered 1000 times the morphine and a nurse was stupid enough to administer it. someone somewhere should have noticed the extreme amount.
