my boyfriend has just started a new job at party city. but this praticular party is not owned my the party city corporate company, his manager is the sole owner of this party city.

problem one, there is no break room in the party city, and hes a little upset because he cant bring food from home to eat for lunch because there is no break room or fridge where he would keep his food. so far everyday hes had to go out and buy food for lunch, and with everything so expensive now-a-days, him having to buy lunch from take out places it really a good idea everyday especially if theres food at his house that he can bring, he says everyone else at the store eats there lunch in there cars..but he doesnt have a car...

second problem is that he works 9-5 there but he doesnt get any break till 4...that doesnt sound right?

the manager at the job hs been nicknamed "the devil" and is known for talking down to workers and yelling at them

  1. Time for your boyfriend to figure out what his goal is. If his goal is to work for a company with descent management practices, time to look for a new job. The odds of driving a change in this one would seem low. If his goal is to force a chance in this store, then some options would be:

    (1) find a labor lawyer,

    (2) research if the store is a franchise and contact the home company.

  2. Document what is going on.  Keep a log of what happens, denying rest breaks or meal breaks and include the date and time.  Keep it for a least a week.  Then call the NYC Bureau of Labor and Industries (BOLI).  Give them the information.  Laws require 15 minutes breaks and a lunch break at certain intervals during the day.  Lunch rooms aren't really required to my knowledge but the BOLI will tell you for certain.

  3. the way u have explained the situation the only option is to look for a new job and quit this one.
