My friend is a 16 year old mother who wanted to give her children up for adoption. She signed away her rights, but the father wanted to keep them and so gained custody. But the father is on welfare and the state of Massachusetts (where we live) is now sueing for child support. Is this legal? What can she do? Isn't she unable to e bound because she is under the age of 18?

  1. No she is not legally bound to pay child support she signed away all rights. In knowing that there father took them in full knowing that she gave up all rights. He can sue all he wants but he wont get a dime. She is 16 yes she can work but the amount of money she would make is not nearly enough for her to pay. Also the courts will see her as a minor and minors can not be placed in that position because they are still full time in school. If he is haveing money problems then he needs to check in to some other programs.

  2. IF she signed her rights away then she is not required to do the child support either.  Signed legal documents will prove to State she is not responsible.

  3. talk  to someone

  4. If she signed her rights away then she doesn't owe child support.

She needs to have all her paperwork and take them with her when she has to go to court.

    Good luck

  5. You say children but not how many, having kids at a young age is not a good thing but it happens and i do not blame the dad or the welfare for going after her for support. At least the dad wanted the children.where are her parents if she is only 16.

  6. Yes she is legally bound to to pay the child suport, but I would call FOC and ask them what she can do to get her out of the sdituation.... I dont think that she should try the hole but I am only 16 route cause she was saying that while having s*x. I think that she should call the local FOC ( friend of the court office) and shee what she has to do to get out of this hole mess.
