what if some one comes from jamaica and he or she is not strait and i would like to foil for them how old would i have to be? what are the things that i need to do?

  1. You would have to be married to that person, or promise to marry them.

    If they are the same s*x as you, then filing for them is simply not allowed. Marriage as recognized by immigration law is between a man and a woman only. It does not matter that the state you might live in, such as California or Massachusetts, allows g*y marriage.

    If they are not the same s*x as you but you are considering marrying them for the purposes of helping them come to the US even though that marriage would not be real, then that is immigration fraud; obviously it's highly illegal and carries a 6-figure fine and several years in a federal prison.

    There is no specific age requirement as long as you are legally allowed to be married in your state. If you are a minor, that would usually require parental consent. If you are 18 or older, then usually no parental consent is required.

    Since you are not married yet, you would be applying for a fiance visa, whereby you will be married to the immigrant within 90 days of their entry into the US.
