Here in florida if i lease a house do i have to live in it?

i have a house with five housemates now do i have to live in it! or can i get my own place and let thier rent pay the bills?

  1. No, you have to have permission to sublease, but you are not even doing that.

    You are renting property you do not own, and you have to be a licensed real estate broker to do that, in addition to a contract with the owner.


  2. This will depend partly on the terms of your lease. Many state that the person who holds the lease must occupy the house. It's probably not a good idea for you to move out, if you are the only lease-holder. That's because you will be responsible for any damages done, even if you are not aware of them and not present when they happen. If you want to move out entirely, it's better to get your name taken off the lease (and perhaps one of your housemate's added.)

That depends upon the terms of your lease.  It's a pretty standard clause that the purpose of the rental is for you to occupy it as your principal residence.  If you do not actually occupy the premises as your principal residence then you are in violation of the terms of your lease and could be evicted (along with everyone else in the place) if your LL wanted to press the issue.  It is also standard practice for your lease to require all occupants go be listed on the lease and many landlord will also require them to SIGN the lease as well.  I always required ALL occupants to sign the lease.

    What you are describing is a sub-lease.  Your landlord must approve a sub-lease.  In most jurisdictions the LL is under no legal obligation to do so, however.  If you sublet without approval hen again the LL can start eviction proceedings.  

    If the LL does approve the sublet, bear in mind that YOU are fully liable to him for the lease payments even if your tenant(s) fail to pay or pay you late.  When you sublet, YOU become the landlord to your tenants and your remedies are the same as the property owner's are with respect to your tenancy.  If they don't pay on time, YOU must evict them but you still must pay your LL on time.
