  1. it is between 00:00 and 04:00  I'm  yet to see any company adhere to the rules though

the actual legislation is as follows

NIght work;  Will be limited to 10 hours working time ina 24 hour period, where any work is carried out during the night time period 00:00 - 04:00hrs.The 10 hour limit maybe exceeded if this is permitted under a collective or workforce agreement.

    if in doubt

    speak to a union rep

if not in a union join gmb online it's only £10 a month

why have I recieved a thumbs down for this ?

  2. True upto a point, it is classed as a night shift, but you can opt out of the WTD,(working time directive) then things get really complicated.

  3. as an hgv driver you can not opt out of the w.t.d .log onto u.k.gov and you can print off the laws on driving time for drivers

  4. Wrong.  The MAXIMUM you can LEGALLY do while driving is an 8 hour shift in a 24 hour period.

  5. Aaron S has got the basics correct. You can only work 15 hours legally, and the maximum daily driving time is 9 hours with a 45 minute break after 41/2, or this 45 mins can be broken into segments. A night shift is defined as per the answer provided by Aaron. I am a HGV driver with over twenty years experience, and in the last three years, the laws governing drivers hours have become increasingly complex, and, when coupled with the current tachograph laws in the UK, they become almost incomprehensible to the untrained, they give me a bleeding headache!!!! Opting out of the W.T.D. does not free you from tacho laws, so in effect, yu can only extend your driving hours to ten hours twice in a week, but you have to repay the 'borrowed' hours the next week, I.E. work six days with two ten hours of driving, the next week you can only work five days. So, week one is 66 hours, week two is 56 hours.Get the idea? Easiest thing is to speak to a transport manager of a large company, or ring the d.o.t. advice line.
