Hi, car stolen. MOT ran out. Insurance sent cheque. Now want MOT C. cheque not cleared. can they cancel it

Hi I had my car stolen and afterwards realised the MOT had run out. The insurance have sent me a cheque paying out in full however they rang me afterwards wanting my MOT certificate. Does anyone know if they can/are likely to cancel the cheque. I didn't let on to them it had ran out, I just said I would sent it on.

  1. If it ran out not too long ago tell the ins coy that you tried to get a duplicate MOT certificate and it was then that you found that it had run out.


  2. They can cancel, and I think they are likely to if they realise you didn't have valid MOT. They will do ANYTHING not to payout...

  3. There is one more thing to add.  It is not illegal to have a car on the road - even being driven on the road if it is going to a prearranged MOT.  SO if you were about to go to an MOT, then you were legal so therfore no reason to not be insurable.

  4. How long overdue was MOT? Was car parked on the road or off road?

  5. The cheque will have been issued 'Without prejudice', meaning that they initially accept the claim but reserve the right to retract the offer.

    Unless you can prove the cars pre-theft condition, they may demand a large quantity of the payment back. Insurance companies have been known to offer scrap value for a car with no MOT.

    As other contributors have already stated, MOT's are now on a data base, the friendly garage for back-dated MOT's is a thing of the past, although you could try and find one that will back date a MOT appointment, but that will raise suspicion.

    The argument  LG forwards regarding travelling for an MOT is slightly inaccurate as the pre-booking system is there for that very purpose, it covers the use of the car for that journey. In most other cases, no tax or MOT does invalidate the insurance.

    I would suggest that they've asked to see the document because they've discovered the truth and need to check that your cars absence on the data base is not just a clerical error.

    I'm afraid you may have to stand this one.

  6. yes, and they will. you must have some contacts, use them to get you a backdated mot, you are gonna lose your money otherwise.

  7. tell them the certificate was in the car when it got stolen.

    no doubt the people who stole the car would have set it on fire to destroy it so there will be no evidence.

  8. Sorry unless you know some one who will give you a MOT Certificate the Insurance company will want the money back.

  9. yes they can cancel the cheque. Had a similar problem when a taxi hit me on a roundabout , totaly his fault insurance found for me , then found out I had no MOT and would not pay out I ended up paying for damage to the taxi out of my own pocket.

    if you do not let the insurance company know about your MOT and they find out it will be classed as insurance fraud (a jailable offence)

    But now they can check on computer  

    If its not  MOT  is not road legal and should not have been in a position to be stolen  

    all sounds  fishy to me !!

  13. at worst they will deduct some of the money. not a great deal depending on how long ago the mot expired. your best bet is to ring them up and explain

  14. tell them it was in the car when it was stolen, and a mate hate the mot done and since died so you dont know where the mot was done

  15. A back-dated MOT?  don't even go there! They are all logged on computer on the day the car passes!  You obviously can't go back in time an re-MOT it, and if you tell them it was in the car, they will simply search to find when the car was last MOT'd...  If you try to hold onto the money, expect criminal charges "obtaining money by deception" and I wouldn't be in your shoes when you NEXT want insurance, because they will really take the p***!

        Take it on the chin and send the cheque back.  You won't get the money out of them anyway.  Best look very honest!  It is what an honest person would do.

INSURANCE IS NOT VOID BECAUSE YOUR MOT EXPIRED.Ask yourself this question, in law, you can take your car too and from an MOT test WITHOUT either a current test AND without a VEL (Vehicle  Excise Licence) IF no MOT invalidated your Insurance, you could never do that. You must inform your insurance of the fact the MOT has expired, do not try to cheat. BE HONEST. They will want the document as they will sell off  the "scrap car". They may take a view that the car is not worth what they offered you, presumably, you had informed them it was currently Tested ? At worse, you may lose an amount of money, if you try to be elusive on this, they could turn nasty and cancel the cheque or sue you to reclaim the amount of overpayment. You will not beat the insurance company.

  20. Very likely - your insurance would be void as you didn't have an MOT.
