Hi I am on H1 visa, And I am on bench (means without job )from october 2006(i got my H1 on Oct 2006). So is there any problem without having paystubs these many days? everybody saying this would became problem when i go to visa stamping. Please help me.

How many days that I can stay without any pay stubs?

  1. The company which applied for your H1 visa has violated regulations concerning employment visas.  They got you a visa and have no work for you, i.e. they're a "body shop."

    You have no job, you have no paystubs, so you are already out of status and have been for close to 2 yrs.  How many are on the bench?  How much did you & the others pay in "agency fees" to get these visas and, supposedly, jobs.  You have been conned.  You need to report the company (call the ICE Hotline) for bringing in people without having jobs for them, and you need to go home.  There is no way you can stay: you cannot get another job, you cannot get another visa, so go home.

  3. Under 180 days, you will be forgiven without paychecks. So it seems you have been out of status way longer than maximum. Talk to immigration attorney asap!!
