Hi I had a crash accident & it was my fault and I didnt have insurance & I got court wat its going to happen?

also the insurance of the other car want to talk to me, but i dont know if wait until the court day and then talk to them.?? I am confuse and scare and I just had a baby and i can not afort to pay all that they are asking me!!

  1. The penalty for driving without insurance varies from state to state. In some states, your vehicle tag can be seized and your car impounded. In addition, some states impose heavy fines for those who drive without auto insurance. Limited sates fine a fee of $150 to $500 for driving without insurance.

    The consequences can be far more serious if you are involved in an accident and do not have insurance. You may have to comply with the financial responsibility laws (SR22, SR22s, SR16) including having to pay for any injuries or damages out of your own pocket.


  2. These days & times are hard, people have a difficult time keeping a roof over their head.  Unfortunately, you made an error.  Even the minimal amount of insurance should be carried.

    What's not to discuss with the other insurance company.  You hit their insureds vehicle.  Give them a statement, let them get started on making the other driver whole.  Their not the ones you have to worry about.  If their insured carried UDW (uninsured deductible waiver) they don't have to pay their deductible.  Also, under normal circumstances it doesn't affect their policy, as their considered a victim.

    The situation is, ( for CA residents) if the damage is over $750 they send a SR1 to DMV which will show that your uninsured.  It does take some time (DMV is always behind), but the may contact you for proof of insurance in the future.

    On the court day, get in front of the judge and be honest.  You'll have to explain your financial situation.  They may ask you to do community service, payment plan, proof of insurance, etc.  Yet to get in front of a judge and lie or give excuses is just going to make things worse.

  3. You need to seek a lawyers advice, go to court and face the music.  If they win, you may end up paying for this for the rest of your life.  Maybe you should have bought insurance instead of a computer?  also....use spell check

    If you had caused injury to anyone else, they would claim on you personally. If you had any assets these could be taken to pay the claim, if you don't, how is the injured party going to be recompensed?

    Sorry, you may have just lost your house, all your possesions and still be in debt for the rest of your life.

    Take some legal advise real quick to see what you can do.

  6. With respect to your court date, if it is a civil matter (if you are being sued by someone for the accident), and

    if you are in the US you should call your local county or state Bar Association.  They will be able to point you in the right direction- there are many attorneys that take cases such as yours on a "pro bono", or free, basis.  

    If that doesn't work, find the law schools that are near you.  Most of them have "clinics" which will help you for free.

    You will likely have to demonstrate your lack of ability to pay- you'll have to show any income you have or expenses.

    Either way, if this is true, please take this seriously and don't talk to anyone until you've had the chance to speak with a lawyer.  Don't make any statements to insurance or anyone.  

    With respect to your court date, if it's for a criminal matter- something like driving without insurance- please call the court or go to it before your trial date and tell them you cannot afford an attorney and wish to have one provided to you by the state or county you are in. Sometimes they will provide one for summary offenses such as that.  Otherwise, you can follow the directions above for civil matters- calling the Bar Associations and local law schools.

You are toast.  Your car registration will be revoked.  Your driving liscence will be suspended.  You will have to pay all damages and medical costs of the other vehicle.  There will be fines for driving without insurance.  There will be fees for reinstating your driving liscence after all the above has been paid off.  You will then pay High risk insurance premiums at 5 times the normal rate for 5 years after your accident.  Welcome to the real world.  Now doncha wish U had paid that car ins bill???   Maybe before you make your next baby you will get your finances in order and comply with the laws of the state you live in concerning financial responsability.  I got more questions and you won't like them either I suspect.  You got the $$$ to pay for the birth of the baby?  U Married?  You know who the baby daddy is?  Is the taxpayer of yer state gonna pay for that child?  U gonna raise the child on welfare?  Please excuse me if I'm wrong,  I see too many children raised on welfare.  My own God Daughter is one.  I can advise but I can't control.  I never had children but I believe the parents should be completely responsable for the costs of a child.  I hope you ride the bus and walk until you can prove your ability to resume your driving privelege.

  8. you're going to have to pay a lot.  you NEED insurance when you're driving a car.  your situation is awful, but they can't take pity on you because you're a new mother.  I'm sorry, but you'll have to find a way to make it work.
